Terms of Service

Version 2.0 · Effective September 28, 2026 · FinVerified, Inc.

The short version. These Terms govern your use of finverified.ai, our free tools, and the FinVerified platform. FinVerified is compliance software. We are not a lender, broker, or law firm, and we never make credit decisions. If your organization has signed a Master Services Agreement with us, that agreement controls where it differs from these Terms. This summary is for convenience; the full Terms below are what govern.

1. Agreement and Scope

These Terms of Service (the “Terms”) are a binding agreement between you and FinVerified, Inc., a Delaware corporation (“FinVerified,” “we,” “us”). They apply to your access to and use of finverified.ai and its subdomains, our free assessment tools, and the FinVerified Payment Pathway Compliance™ platform and related services (together, the “Services”).

Customers under contract. If you access the Services on behalf of an organization that has executed a FinVerified Master Services Agreement, Provider Enrollment Agreement, Lender Partner Agreement, Order Form, or other written agreement with us (a “Customer Agreement”), the Customer Agreement governs that organization’s subscription. If these Terms conflict with a Customer Agreement, the Customer Agreement controls.

Patients. If you are a patient or responsible party using a FinVerified workflow sent to you by your healthcare provider, the Patient Terms of Use apply to you instead of these Terms.

By accessing or using the Services, creating an account, or clicking to accept these Terms, you agree to them. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization. If you do not agree, do not use the Services.

2. What FinVerified Is, and Is Not

FinVerified provides software and related services that help healthcare practices, dental service organizations, management services organizations, and lender partners document, monitor, and improve the compliance of patient payment and patient-financing workflows. These include jurisdiction-specific disclosure workflows, consent capture, training, evidence records, monitoring, and reporting.

FinVerified does not provide, manage, or facilitate patient financing. FinVerified is not a lender, creditor, loan broker, arranger of credit, debt collector, payment processor, money transmitter, healthcare provider, or law firm. We do not originate, approve, fund, price, service, collect, or guarantee any loan or credit product, and we do not make or influence credit or underwriting decisions. Any financing a patient obtains is provided solely by an independent lender under that lender’s own terms.

No legal advice. Our content, scores, assessments, alerts, reports, templates, and other outputs are software and informational tools. They are not legal, regulatory, tax, financial, or medical advice, and no attorney-client or other professional relationship is formed by your use of the Services. Laws vary by jurisdiction and change over time. You should consult qualified counsel about your specific practices.

3. Eligibility

The Services (other than patient workflows) are intended for business use by individuals at least 18 years old acting on behalf of an organization. You may not use the Services if you are barred from doing so under applicable law, if you are located in or ordinarily resident in a country subject to comprehensive U.S. sanctions, or if you or your organization appear on a U.S. government restricted-party list.

4. Accounts and Security

  • You must provide accurate, current, and complete registration information and keep it updated.
  • You are responsible for safeguarding your credentials, for enabling any multi-factor authentication we offer, and for all activity under your account, except to the extent caused by our breach of these Terms.
  • Account administrators are responsible for granting, changing, and promptly removing user access, including for departed personnel.
  • Notify us immediately at legal@finverified.ai if you suspect unauthorized access or a security incident involving your account.

5. Free Tools and Assessments

Our free tools (including Am I Compliant?, My Fraud Exposure, Network Risk Index, and the Walkout Calculator) produce scores and estimates based solely on the answers and figures you enter, using the scoring methods described on each tool. Results are illustrative, are not an audit, certification, or legal opinion, and are not a guarantee or projection of any regulatory outcome, revenue, savings, or fraud reduction. Do not enter patient names or other patient information into a free tool.

6. Subscriptions, Fees, and Billing

Paid Services are provided under a Customer Agreement and Order Form, which set out the enrolled locations, subscription term, fees, and billing cadence. Our current standard rates are published on our pricing page. Unless your Customer Agreement states otherwise:

  • Payment. Fees are billed in advance through our payment processor, Stripe, and you authorize recurring charges to your payment method on file for subscription, seat, location, one-time, and tax amounts due.
  • Renewal. Month-to-month subscriptions renew monthly until canceled. Annual subscriptions renew for successive twelve-month terms unless either party gives at least thirty (30) days’ notice before renewal. Annual commitments billed monthly remain payable for the full term.
  • Cancellation. You may cancel a month-to-month subscription before the next renewal charge; cancellation takes effect at the end of the paid period.
  • Refunds. Fees are non-cancelable and non-refundable except as expressly stated in your Customer Agreement or required by law.
  • Taxes. Fees exclude applicable sales, use, and similar taxes, which you are responsible for (excluding taxes on our net income).
  • Price changes. We may change list prices on at least thirty (30) days’ notice, effective at your next renewal.
  • Disputes and late payment. Raise good-faith billing disputes within thirty (30) days of the charge. We may suspend Services for undisputed amounts that remain unpaid after notice.

7. Acceptable Use

You must use the Services in compliance with applicable law and our Acceptable Use Policy, which is part of these Terms. Among other things, you may not use the Services to misstate financing terms, promise approval, steer patients on any impermissible basis, submit an application without a patient’s authorization, or evade any lender, regulator, or disclosure requirement.

8. Your Data, Privacy, and HIPAA

Ownership. As between you and FinVerified, you own the data you submit to the Services (“Customer Data”). You grant us a limited, non-exclusive right to host, process, transmit, and use Customer Data as necessary to provide, secure, support, and improve the Services and to comply with law.

Privacy. Our Privacy Policy describes how we handle personal information. We may create and use aggregated or de-identified data that does not identify you, any patient, or any individual.

Protected Health Information. A Business Associate Agreement (“BAA”) must be in effect between your organization and FinVerified before you transmit any protected health information (“PHI”) through the Services. The BAA governs PHI and controls over these Terms. Submitting PHI without a BAA in effect is a material breach of these Terms. See our HIPAA and PHI Statement.

Your responsibilities. You represent that you have all rights, notices, consents, and authorizations needed for us to process Customer Data, and that you will submit only the minimum data reasonably necessary.

9. AI-Assisted Features

Some features use automated rules or artificial intelligence to generate coaching, summaries, risk indicators, or recommendations. These outputs are decision-support tools, may be incomplete or inaccurate, and require human review before you rely on them. They are not legal advice or credit, underwriting, or medical decisions. We do not use PHI to train generally available AI models.

10. Intellectual Property

FinVerified and its licensors own the Services, including software, interfaces, workflows, disclosure libraries, templates, methodologies, models, reports, documentation, the MCF® training standard, and our trademarks, together with all improvements. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to use the Services for your organization’s internal business purposes. You may not copy, scrape, resell, sublicense, reverse engineer, circumvent security of, or build a competing product from the Services. If you provide feedback, we may use it without restriction or obligation.

11. Third-Party Services and Lenders

The Services may link to or integrate with third-party products, including lenders, payment processors, and practice-management systems. Those third parties are independent, their offerings are governed by their own terms and privacy policies, and FinVerified is not responsible for them. A lender’s appearance in the Services is not an endorsement, recommendation, or guarantee of any credit decision or terms.

12. Communications

You agree that we may send you service, security, billing, and legal notices electronically, and that electronic notices satisfy any requirement that notices be in writing. Where you opt in, we may also send marketing messages, which you can unsubscribe from at any time. Text messaging is governed by our SMS Terms.

13. Disclaimers

Except as expressly stated in a Customer Agreement, the Services are provided “as is” and “as available.” To the maximum extent permitted by law, FinVerified disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Services will be uninterrupted, error-free, secure, or sufficient to satisfy every legal or regulatory requirement applicable to you. FinVerified does not warrant any regulatory outcome, lender decision, approval rate, revenue result, or fraud result.

14. Limitation of Liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, goodwill, business opportunity, or data, even if advised of the possibility. Except for your payment obligations, a party’s indemnification obligations, breach of confidentiality, infringement or misappropriation of the other party’s intellectual property, fraud, gross negligence, or willful misconduct, each party’s total liability arising out of or relating to these Terms will not exceed the fees paid or payable by you to FinVerified for the Services during the twelve (12) months before the event giving rise to liability, or one hundred U.S. dollars (US $100) if you have not paid fees.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

If you use the Services on behalf of an organization, that organization will defend, indemnify, and hold harmless FinVerified and its affiliates, officers, directors, employees, and agents from third-party claims arising from (a) your healthcare services, goods, financing presentations, lender relationships, refunds, or patient disputes; (b) Customer Data or your lack of required rights or consents; (c) your unlawful, fraudulent, or unauthorized use of the Services; or (d) your breach of these Terms or the Acceptable Use Policy.

16. Suspension and Termination

We may suspend or restrict access to protect the Services or others, comply with law, address a security risk, prevent fraud or misuse, or respond to non-payment, and will use reasonable efforts to give notice when practicable. Either party may terminate as provided in a Customer Agreement; absent one, you may stop using the Services at any time and we may terminate your access for material breach. Following termination, you may request an export of available Customer Data for thirty (30) days, subject to payment of amounts due and legal retention requirements. Provisions that by their nature should survive will survive.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and each party consents to personal jurisdiction and venue there. Each party waives trial by jury to the extent permitted by law. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

18. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new effective date and, for material changes, give reasonable advance notice by email or in the Services. Changes apply prospectively. For Customers under a Customer Agreement, material changes apply at renewal unless required sooner by law or security needs. Continued use after the effective date means you accept the updated Terms.

19. General

  • Relationship. The parties are independent contractors. Nothing creates a partnership, agency, fiduciary, franchise, employment, lender-broker, or joint-venture relationship.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign them to an affiliate or in connection with a merger, financing, reorganization, or sale of our business or assets.
  • Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, excluding payment obligations.
  • Export and sanctions. You will comply with applicable U.S. export-control and sanctions laws.
  • Severability and waiver. If a provision is unenforceable, it will be modified to the minimum extent necessary and the rest remains in effect. A waiver must be in writing.
  • Entire agreement. These Terms, together with the policies they reference and any Customer Agreement, are the entire agreement regarding their subject matter.
